Terms and Conditions

1. Conclusion of Contract

Bookings can be made by phone, in writing, by e-mail, or directly via our website www.manapihusky.com. The full name, address, telephone number, and number of accompanying persons must be provided. The contract becomes effective upon our acceptance (booking confirmation). After conclusion of the contract, you will receive written confirmation.

2. Payment

  • Deposit: 20% of the travel price within 10 days after conclusion of the contract.

  • Final Payment: No later than 6 weeks before departure.

  • Short-term Bookings: For bookings made within 6 weeks before departure, the total amount is due immediately.

Surcharges:

  • Booking ≤ 48 hrs before start: +10%

  • Booking ≤ 24 hrs before start: +20%
    (All prices incl. VAT)

If payment is not made on time, the organizer may withdraw from the contract after issuing a reminder with a deadline and claim cancellation fees in accordance with section 4.

 

3. Services and Service Changes

The scope of services is defined in the booking confirmation. Necessary changes to individual services are permissible, provided they are not significant and do not affect the overall character of the trip. We will inform you of changes immediately. Free rebooking or withdrawal will be offered if changes are significant.

4. Cancellation and Rebooking by the Customer

  • Rebooking: We offer alternative dates if possible.

  • Cancellation: In case of cancellation, we retain the paid deposit (20%) as a processing and cancellation fee. Refund of the deposit is excluded.

5. Unused Services

There is no entitlement to reimbursement in the event of early departure or for reasons attributable to the customer. No reimbursement is granted for weather-related changes or cancellations (e.g. storms, extreme temperatures).

6. Withdrawal by the Organizer

The organizer may withdraw from the contract:

  • If the minimum number of participants (as per booking confirmation) is not reached up to 14 days before the start.

  • In the event of serious disruption of the trip by the guest or unsuitability due to physical/mental conditions.

In both cases, a partial refund may be granted.

7. Warranty

Defects must be reported immediately to allow remedy. For justified complaints, we provide equivalent or higher-value replacement services or grant a price reduction.

8. Risks of Outdoor Activities

By booking, the participant confirms:

  • Awareness of risks, especially regarding snowmobile rides.

  • Responsibility for protective clothing and compliance with all regulations.

  • Good physical condition appropriate for the activity.

9. Liability

  • Liability for property damage (excluding personal injury) is limited to three times the travel price, unless caused by gross negligence or intent.

  • No liability for third-party services or damages caused by participant misconduct.

  • Participation in activities is at the participant’s own risk.

10. Insurance

We strongly recommend the conclusion of the following insurances:
Travel cancellation, travel luggage, travel health, travel accident, and travel liability insurance.

 

11. Regulations

Guests are responsible for compliance with all legal requirements (e.g. customs, passport validity).

 

12. Duty to Cooperate

Guests are obliged to prevent or minimize damage and to inform the organizer of possible risks.

 

13. Severability Clause

If any provision is invalid, the remainder of the contract remains valid. We reserve the right to make changes at any time.

 

14. Use of Accommodation

Guests must treat the accommodation and its inventory with care. Damages must be reported immediately.
Before departure, the guest must leave the accommodation in proper condition. Waste must be disposed of properly, and major dirt must be cleaned. Otherwise, an additional cleaning fee may be charged.

 

15. Brought Pets and Liability

Pets are allowed only upon prior agreement. Guests are responsible for ensuring pets cause no disturbance or damage.
A valid dog liability insurance policy must be presented before arrival.
Guests are liable for all damages caused by their pets, both in the accommodation and during activities.

 

16. Smoking

Smoking is strictly prohibited in all enclosed areas.
Outdoors, smoking is permitted only in designated areas. Cigarette waste must be disposed of properly.
Smoking near the dogs is strictly prohibited. The protection and well-being of the dogs are the highest priority.

 

17. Vouchers

  • Order and Delivery: Vouchers can be purchased on site, by e-mail, by phone, or via our website.

  • The voucher will be sent by post to the address provided by the buyer after full payment. Additional shipping fees may apply and will be specified during the ordering process.

  • Vouchers can only be redeemed for the services stated on them. If no specific service is mentioned, the voucher applies to all services we offer.

  • Cash payouts or partial payouts of voucher value are excluded.

  • After expiration of the validity period, the voucher becomes void. The statutory limitation period of three years remains unaffected.

  • We accept no liability for loss or damage of vouchers. Replacement vouchers are not issued.

18. Booking of Activities

Conclusion of Contract:
By submitting a written registration, the customer offers the organizer the binding conclusion of a contract. The contract becomes effective upon written confirmation by the organizer. By signing, the customer also accepts the general terms and conditions on behalf of any registered participants. This also applies to partial services such as rental of snowmobiles or snowshoes.

 

19. Services

a) The scope of contractual services results from the service description and the organizer’s confirmation.
b) Changes necessary after conclusion of contract are only permitted if they do not impair the overall character of the activity. The organizer is obliged to inform you of such changes.
c) The organizer reserves the right to replace individual services with equivalent ones if necessary for organizational or weather-related reasons.

 

20. Withdrawal by the Customer

You may withdraw from the activity at any time before it begins or provide a substitute participant. For activities tailored specifically for the customer, we reserve the right to accept the substitute participant. To avoid misunderstandings, we recommend written withdrawal. We may claim compensation for arrangements already made.

 

21. Withdrawal and Termination by the Organizer

The organizer may terminate the contract without notice if the customer, despite warning, persistently disrupts the activity or behaves in a grossly inappropriate manner. The organizer retains the right to payment.

 

22. Warranty

a) Remedy: If the activity is not carried out in accordance with the contract, the customer may demand remedy. The organizer may refuse if it requires disproportionate effort. Remedy may also be provided by offering an equivalent replacement service.
b) Price Reduction: For the duration of non-conforming services, the customer may demand a price reduction, except when failing to report the defect.

 

23. Liability

We are liable, within the duty of care of a prudent merchant, for proper preparation and execution, careful selection of service providers, accuracy of service description, and proper provision of agreed services. Participation in activities involving particular risks, especially sports and/or outdoor activities, is at the participant’s own risk. We are only liable for intent and gross negligence.

For damages that are not personal injuries, liability is limited to three times the price.
We are not liable for disruptions in services that are provided solely as third-party services.

 

24. Liability for Rented Sports Equipment/Vehicles

The customer is liable for any damage or loss of rented sports equipment/vehicles and gear, even if used as part of an arrangement.

 

25. Extraordinary Circumstances – Force Majeure

If the activity is significantly hindered, endangered, or impaired by unforeseeable events (e.g. war, natural disasters), both the customer and the organizer may terminate the contract. The organizer will refund payments received but may charge a reasonable fee for services already provided or still to be provided until termination.

26. Duty to Cooperate

The customer must do everything reasonably possible to help remedy any disruptions and to minimize any potential damage. All complaints must be reported immediately to the organizer. If the organizer is unavailable, complaints must be sent promptly by telegram.

27. Passport, Visa, and Health Regulations

The customer is solely responsible for compliance with passport, visa, currency, customs, and vaccination regulations. By registering, the customer confirms there are no medical concerns against participation.

28. Invalidity

Invalidity of individual provisions does not affect the validity of the entire contract. The same applies to these terms and conditions.
